Virginia Court Rules that Lack of Pre Employment Screening Leaves Employer Liable for Damages
The 4th U.S. Circuit Court of Appeals in Virginia has ruled that a college student is allowed to continue with her claims for negligent hiring and retention against a janitorial staffing service after allegedly being attacked by an employee of the service. Employers are charged with a duty to exercise reasonable care in the hiring and retention of their employees. Conflicting State and Federal Laws Hinder Pre Employment Screening in N.C. Nursing Homes

Effective January 31, 2005 - FTC Requires Employers to Provide Revised Version of FCRA Summary of Rights to Applicants
President Bush signed the Fair and Accurate Credit Transactions Act (the Fact Act) into law on December 04, 2003, amending the FCRA in several respects. The Fact Act required the Federal Trade Commission (FTC) to create new notices reflecting these changes. On November 30, 2004, the FTC released the final version of the revised notices to consumers (employees and applicants), furnishers of information (i.e. Inquest Pre Employment Screening), and users of consumer reports (i.e. Inquest Clients). The revised notices take effect on January 31, 2005.
