1. Before an Investigative Consumer Report is requested:

  • Provide Certification to Consumer Reporting Agency (FCRA & ICRAA)


  • Make a clear and conspicuous written disclosure to the consumer before the report is obtained, in a document that consists solely of the disclosure that an investigative consumer report may be obtained. Obtain prior written authorization from the consumer. Provide consumer with a summary of his/her rights under the FCRA. (FCRA)

California Employers Only

  • Obtain consent under CA Civil Code Section 1786(a)(2). This is included in the California Disclosure and Consent for Procurement of a Consumer and Investigative Consumer Report and Release Authorization.

  • Provide consumer with a summary of the provisions of section 1786.22 (ICRAA)

2. Upon receipt of Consumer Report

California, Minnesota and Oklahoma Employers Only
  • If applicant has checked the box on the California Disclosure and Consent for Procurement of a Consumer and Investigative Consumer Report and Release Authorization indicating that they wish to receive a copy of their report, provide a copy within three (3) business days.



3. Prior to Taking Adverse Action based on information contained in whole or in part in a consumer report

4. Upon Taking Adverse Action

  • Provide consumer with a notice of adverse action that includes the name, address and phone number of the consumer reporting agency that prepared the report.
